  4.             SUMMARY OF STATE LIVING WILL LEGISLATION

  6. WISCONSIN

  8. Synopsis: Wisconsin has a strong living will statute. The statute
  9. requires that physicians record the fact of execution of a living
  10. will in the patient's medical records. The statute requires that
  11. physicians/hospitals who decline to implement living wills to
  12. assist in transferring the patient. To prepare a living will
  13. using the State of Wisconsin recommended form, please select
  14. living will preparation from the opening menu. Remember that the
  15. publisher recommends preparing a "uniform" living will in
  16. addition to the form suggested with by the State of Wisconsin.
  17. Please also consider executing a living will for any State that
  18. you spend more than a few weeks per year, or where you are a
  19. temporary resident.

  30. Witness requirements: Number: 2  Relationship: Witnesses may
  31. not be related by blood or marriage, may not be entitled to
  32. inherit either under a will or by the laws of intestacy of the
  33. declarant, and may not be a member of the attending medical 
  34. staff. Individuals who are not members of the attending medical
  35. staff may nevertheless be witnesses.

  39. Revocation of the living will may be made by tearing, defacing, 
  40. burning, etc. It may also be revoked in writing. It may be
  41. verbally revoked if the fact of the revocation is communicated to
  42. the attending physician. The fact of revocation is to be noted on
  43. the patient's medical records.
